Terms of use

The rules that apply to the Ex Inferis website and to alpha versions of the game.

1. Purpose and acceptance

These terms govern access to the Ex Inferis website, the download and use of any test version of the game, and participation in beta-testing activities. By accessing the site, downloading the game, or using it, you agree to these terms. If you do not agree, do not install or use the game.

If you are a minor, you must use the game with the permission of your parent or legal guardian whenever applicable law requires it.

2. Experimental nature of the alpha

The available build is intended to test a product that is still in development. Features may be missing, provisional, changed, or removed without notice. Content, balance, performance, compatibility, controls, and technical requirements may change between builds.

No guarantee is made regarding permanent availability of the game or site, continuation of a testing campaign, preservation of progress, or compatibility of save files between versions.

3. Licence to use

Subject to these terms, you receive a personal, limited, non-exclusive, non-transferable, and revocable licence to install and use the test build for private evaluation purposes. No ownership right in the game or any of its components is transferred to you.

To the extent permitted by law, you must not:

  • sell, rent, license, or redistribute the game without permission;
  • circumvent a security measure or access control;
  • knowingly exploit an error to disrupt testing or harm another person;
  • decompile, disassemble, or modify the game, except where mandatory law allows it.

4. Tester precautions

Before installing or updating, use a dedicated folder, read the release notes, review the known issues, and keep a copy of any data you consider important. Do not rely on a single save file if losing it would have a significant impact on you. You remain responsible for the security and compatibility of your device and backups.

5. Health and comfort

Take regular breaks and play in suitable conditions. Stop immediately if you experience discomfort, dizziness, eye strain, nausea, or any unusual reaction. People who are sensitive to animated images or lighting effects should follow precautions recommended by a health professional.

6. Feedback and contributions

You retain your rights in original text, screenshots, and other material included in your feedback. To the extent that you hold the necessary rights, you grant the Ex Inferis project a worldwide, royalty-free, non-exclusive, and lasting permission to analyse, reproduce, adapt, and use that feedback to develop, fix, document, and promote the game. Do not submit confidential material or content owned by a third party without permission.

7. Third-party services and links

The site may link to third-party services, for example to distribute the game or host tester discussions. Those services operate under their own terms and policies. Ex Inferis does not control their availability or their handling of data. Review their rules before using them.

8. Intellectual property

The game, the site, and their text, world, characters, artwork, audio, music, software, trade marks, and other components are protected by the intellectual-property rights of their owners. Unauthorised use is prohibited, subject to exceptions provided by law.

9. Liability

To the fullest extent permitted by law, Ex Inferis does not warrant that this alpha will be error-free, meet a particular need, or run without interruption on every configuration. Ex Inferis is not liable for indirect loss, loss of progress, data, or opportunity arising from use of a test build where such an exclusion is legally allowed.

You remain responsible for your backups and for reasonable precautions related to installation. Where liability cannot be excluded, it is limited to direct, foreseeable, and proven loss caused by a breach attributable to Ex Inferis. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or gross negligence, death or personal injury, or under mandatory consumer law.

10. Personal data

The site does not create user accounts. Information about handled data, technical logs, and external services appears in the privacy notice. Avoid including unnecessary personal data in an issue report.

11. Suspension and termination

Access to a test build or community space may be suspended or withdrawn following a breach of these terms, abuse, a security risk, or the end of a campaign. You may stop using the game at any time and delete the installed files.

12. Changes to these terms

These terms may change with the game, the website, or the legal framework. The update date appears at the top of this page. Material changes will be notified in a reasonable manner. Continued use of a new build after that notice constitutes acceptance of the updated terms, subject to applicable mandatory rights.

13. Governing law and contact

These terms are governed by Belgian law, without depriving a consumer of mandatory protection available under the law of their country of residence. Competent courts are determined by applicable legal rules. For any question, contact exinferiscontact@gmail.com.
